UPDATE- April 21, 2017EESD Confidentiality of Records Regulations: "Package 1" of the California Code of Regulations, Title 5 has been submitted to the Office of Administrative Law (OAL). The package contains the following sections:

  •  18117: Confidentiality of Records
  •  18246: Confidentiality of Information

Pursuant to the requirements of Government Code section 11346.4(a), the State Superintendent of Public Instruction is providing notice of the proposed regulatory action with regards to the above-entitled regulations. The proposed regulatory action can be found HERE

The public commentary period begins on April 22, 2017 and ends on June 5, 2017. Please feel free to forward comments to mona@cappaonline.com, so that we may be aware of your concerns, as well will be providing a response, as well. A public hearing will be held on June 5, 2017 at 1:30pm at 1430 N Street, Room 1801, Sacramento, CA.

UPDATE- March 9, 2017: CDE has posted: "EESD Title 5 Revisions Project - information and resources on the Early Education and Support Division (EED) process to revise the California Code of Regulation, Title 5, Chapters, 19 and 19.5" on their website.

INTRODUCTION AND SUMMARY: The CDE/EESD has announced plans and a process to promulgate regulations that will update the California Code of RegulationsTitle 5 (5 CCR)Chapters 19 and 19.5. Many of the provisions of these regulations need to become current and aligned with California laws recently enacted, as well as the federal Child Care and Development Fund (CCDF) Program Final Rule, published September 30, 2016. 

As a first step in this process, EESD solicited input from its contractors, partners, and stakeholders. Over 517 suggestions were received through emails, AB 104 recommendations, and fall conference stakeholder meetings. These suggestions could potentially impact 46% of the 211 regulations found in Chapters 19 and 19.5. CDE has compiled a list of the code sections to which there were suggestions, which can be found hereAll comments received will be posted to CDE's website shortly. CDE has stressed that they are still open to suggestions and are committed to transparency and stakeholder involvement throughout the process.
